Terms of Service

VolcanoBox is a technology, logistics, and marketplace platform that connects customers with curated cultural products, experiences, vendors, suppliers, and fulfillment partners. VolcanoBox does not manufacture most products listed on the platform. Many products are sourced from independent suppliers, distributors, and vendors. Fulfillment may be performed by third-party fulfillment partners operating under separate operational agreements. By using VolcanoBox, you agree to be bound by these Terms of Service, our Privacy Policy, Shipping & Fulfillment Policy, Refund & Returns Policy, Community Guidelines, and VolcanoBucks Policy.

2.1 You must be at least 18 years of age to use VolcanoBox and create an account. 2.2 You agree to provide accurate, current, and complete information during registration and to maintain the accuracy of that information. 2.3 You are responsible for maintaining the confidentiality of your account credentials and password. 2.4 VolcanoBox reserves the right to suspend or terminate accounts that violate these terms, engage in fraud, abuse, or harassment, or violate community guidelines. 2.5 You may not use the platform to: • Resell or redistribute products for commercial profit without written authorization • Engage in fraudulent transactions or payment manipulation • Post false or misleading product information • Harass, threaten, or abuse other users or staff • Violate applicable laws or regulations • Manipulate promotional credits or founder access programs

3.1 VolcanoBox curates and coordinates cultural products, groceries, foods, and experiences. Products may be sold and fulfilled by VolcanoBox itself or by the independent seller identified on the listing and order. 3.2 Product availability, inventory, and pricing are subject to change without notice. 3.3 VolcanoBox reserves the right to: • Substitute products of equal or greater value if items become unavailable • Modify fulfillment timelines based on supplier availability • Cancel orders due to inventory errors or supplier unavailability • Adjust product descriptions, images, or availability 3.4 Imported products may vary in packaging, labeling, ingredient formatting, or freshness compared to North American standards. This is not a defect and does not constitute grounds for refund unless the product is damaged or unsafe. 3.5 Seasonal and limited-edition products may become unavailable without notice.

4.1 Founder Credits are promotional launch incentives and do not represent: • Stored monetary value or cash equivalents • Gift cards, vouchers, or payment instruments • Banking instruments, securities, or investments • Guaranteed future platform value or equity • Ownership or investment rights in VolcanoBox 4.2 Promotional credits are: • Non-transferable and non-refundable (except as required by law) • Valid only for purchases on the VolcanoBox platform • Subject to expiration dates specified at issuance • Forfeited upon account termination or inactivity 4.3 VolcanoBox reserves the right to: • Modify or revoke promotional credits at any time with notice • Suspend credits for fraudulent activity, abuse, or ToS violations • Adjust promotional campaigns or eligibility criteria • Require documentation of eligibility for founder access 4.4 Expired credits cannot be restored or transferred to new accounts. 4.5 Credits do not earn interest, have no secondary market value, and cannot be liquidated or exchanged for cash.

5.1 Payment processing is handled by Stripe and/or other third-party payment processors. VolcanoBox is not a payment institution or bank. 5.2 By initiating a transaction, you authorize VolcanoBox and its payment processors to charge your selected payment method. 5.3 All transactions are final. Refunds are subject to our Refund & Returns Policy. 5.4 e-Transfer payments and manual payment submissions are processed within 24-48 business hours. Processing delays may occur. 5.5 Payment information is protected under PCI DSS standards via our payment processors. VolcanoBox does not store full credit card details. 5.6 You are responsible for any transaction disputes with your bank or payment provider.

6.1 VolcanoBox coordinates fulfillment with independent suppliers and regional fulfillment partners. Delivery timelines are estimates and are not guaranteed. 6.2 Fulfillment partners operate independently and are responsible for: • Local product handling, packing, and preparation • Regional inventory management • Compliance with local food safety and logistics regulations • Direct communication regarding order status 6.3 VolcanoBox is not responsible for: • Late deliveries caused by fulfillment partners, carriers, or customs • Shipping carrier delays or miscommunication • Local operational issues at fulfillment locations • Customs clearance delays for imported products • Regional weather impacts or force majeure events 6.4 Delivery times vary by region and fulfillment partner. Estimated ship dates are provided as a courtesy and are subject to change. 6.5 You are responsible for providing an accurate shipping address. 7.1 To the maximum extent permitted by law, VolcanoBox shall not be liable for: • Indirect, incidental, consequential, emotional, reputational, or economic damages • Lost profits, lost data, or business interruption • Damages arising from third-party vendor or fulfillment partner conduct • Shipping carrier errors or delays • Customs or regulatory delays • Product substitutions or inventory shortages • Seasonal product unavailability • Food allergies, sensitivities, or nutritional differences • Imported product labeling or ingredient variations • User-generated content or community interactions • Influencer promotions or sponsored campaigns • Platform outages or technical issues 7.2 In no event shall VolcanoBox's total liability exceed the amount paid by you in the last 12 months. 7.3 Some jurisdictions do not allow limitation of liability. To the extent applicable law prohibits any limitation, the above disclaimer does not apply to you. 7.4 You use the VolcanoBox platform "as is" and assume all risk of use.

8.1 VolcanoBox partners with independent suppliers, vendors, and fulfillment partners to deliver products and services. 8.2 These third parties are independent contractors and are not employees, agents, or representatives of VolcanoBox. 8.3 VolcanoBox is not responsible for: • Vendor or partner conduct, policies, or compliance • Product quality issues originating from suppliers • Service failures by fulfillment partners • Miscommunication between partners and customers • Operational decisions made by independent partners 8.4 Disputes with vendors or fulfillment partners should be escalated through VolcanoBox support, who will coordinate resolution. 8.5 VolcanoBox reserves the right to remove vendors or partners from the platform at any time.

9.1 VolcanoBox provides storefront and ordering tools connecting customers with independent sellers. The seller identified on the listing and order is responsible for that seller's products and fulfillment. When VolcanoBox itself is the seller, it retains its responsibilities for its own sales. 9.2 Independent sellers are responsible for lawful operation in their location, any required permits or authorizations, product safety, accurate ingredients and allergen information, labeling, taxes, availability, preparation, and fulfillment. Seller registration is not a license, inspection, or certification by VolcanoBox. 9.3 Customers should review the seller, product details, pickup arrangements, and refund information before ordering and ask the seller about ingredients or other concerns. This does not remove either the seller's or VolcanoBox's obligations under applicable law. 9.4 Payments follow the methods and currency actually shown at checkout. Registration in a country does not activate payment processing there. Seller-direct payment features remain unavailable until configured and enabled; existing VolcanoBox payment arrangements are unchanged. 9.5 Problems may be reported through the Support page. VolcanoBox may pause a product, seller, or city for safety, fraud, legal requirements, or platform-rule violations. A pause does not cancel existing refund or fulfillment obligations. 9.6 Sellers must accept the separate Seller Agreement, available at /legal/sellers. No licensing badge or verified status is implied by appearing on the platform. 9.7 Nothing in these Terms, the Seller Agreement, or linked policies waives rights that applicable law does not permit to be waived, or excludes responsibilities that law places on VolcanoBox. This provision prevails over conflicting disclaimers in those documents.

10.1 Many products offered on VolcanoBox are imported from Central America, South America, Caribbean nations, and other international suppliers. 10.2 Imported food and product items may differ from Canadian labeling standards, packaging, ingredient formatting, or freshness timelines. These differences are not defects. 10.3 You are responsible for reviewing ingredient and allergy information prior to consumption or use. 10.4 VolcanoBox is not responsible for: • Allergic reactions or sensitivities due to ingredient exposure • Nutritional or dietary differences compared to North American equivalents • Regional packaging variations or labeling format differences • Freshness variability due to import timelines • Ingredient substitutions made by suppliers • Customs holds or import regulation delays 10.5 If you have known allergies, dietary restrictions, or sensitivities, contact customer support before ordering. Many imported products may contain trace allergens or shared equipment exposure. 10.6 Product substitutions may occur due to inventory variance. You will be notified of material substitutions. 10.1 By submitting content (reviews, photos, stories, social media tags, community posts) to VolcanoBox, you grant VolcanoBox a non-exclusive, royalty-free, worldwide license to: • Repost, republish, and display your content on the platform • Use your content in marketing materials and social media • Modify or adapt content for platform consistency • Archive and use content for analytics purposes 10.2 You retain ownership of your original content, but grant VolcanoBox perpetual rights to use submissions. 10.3 VolcanoBox community guidelines prohibit: • Hate speech, discrimination, or harassment • Fraud, fake reviews, or manipulation • Spam, impersonation, or false identity • Sexual or violent content • Promotion of illegal activity • Sharing of personal information without consent 10.4 VolcanoBox reserves the right to moderate, edit, or remove any user content that violates these guidelines. 11.1 VolcanoBox regularly conducts giveaways, referral campaigns, founder access programs, and promotional launches. 11.2 Promotional campaigns: • Are subject to availability and limited quantities • May change or end at any time without notice • Are "while supplies last" unless otherwise stated • May have eligibility requirements (age, location, account status) • Are non-binding promotional offers 11.3 Giveaway winners are selected at VolcanoBox's sole discretion. VolcanoBox is not responsible for giveaway entries lost due to technical issues. 11.4 Influencer promotions and sponsored content do not constitute endorsement or guarantee by VolcanoBox. 11.5 No purchase necessary for giveaway entry where legally required, but account creation may be required.

VolcanoBox collects and processes personal data in accordance with our Privacy Policy and PIPEDA requirements. By using the platform, you consent to data collection, analytics, marketing communications, and third-party payment processing as outlined in our Privacy Policy. 13.1 VolcanoBox reserves the right to modify these Terms of Service at any time. Changes are effective upon posting to the platform. 13.2 Your continued use of the platform after modifications constitutes acceptance of the updated terms. 13.3 Material changes will be announced via email notification, but continued platform use signifies acceptance.

14.1 These Terms of Service are governed by the laws of the Province of British Columbia, Canada, without regard to conflict of law principles. 14.2 All disputes arising from use of VolcanoBox shall be resolved in the courts of British Columbia. 14.3 You consent to the exclusive jurisdiction and venue of British Columbia courts.
